Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Berean Defense LLC ("Formation Bible Study," "we," "us," or "our"), a Wyoming limited liability company, governing your access to and use of the Formation Bible Study application, website at formationbible.com, and all related services (collectively, the "Service").

These Terms incorporate our Privacy Policy and Cookie Policy by reference. Please read all three documents together — they form the complete agreement between you and Formation Bible Study.

If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. References to "you" include both you individually and any such organization.

Formation Bible Study is intended for users who are at least 13 years of age. The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that a user is under 13, we will promptly delete their account and associated data.

If you are between the ages of 13 and 17, you represent that a parent or legal guardian has reviewed and consented to these Terms on your behalf and agrees to be responsible for your use of the Service.

By using Formation Bible Study, you represent and warrant that: (a) you meet the age requirements above; (b) you have the legal capacity to enter into this agreement; (c) you are not prohibited from using the Service under any applicable law; and (d) all information you provide to us is accurate, current, and complete.

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you.

Formation Bible Study offers a permanent free tier and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe, Inc.

Formation Bible Study is a Bible study tool built for serious learners and communities of faith. Use it in a way that is lawful, respectful, and consistent with its purpose.

You agree NOT to use Formation Bible Study to:

We reserve the right to investigate any suspected violation of these guidelines and to remove content or suspend accounts at our sole discretion, without notice, if we determine a violation has occurred.

You retain full ownership of the notes, highlights, bookmarks, journal entries, and other content you create within Formation Bible Study ("Your Content"). We do not claim any intellectual property rights over it.

By submitting content to Formation Bible Study, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, host, display, and process Your Content solely for the purposes of providing and improving the Service to you. This license ends when you delete the content or close your account.

We do not sell Your Content, use it for advertising, or use it to train AI models. Your study notes, prayer journal, and reflections are yours.

For content you share in community features (discussion boards, study groups), you grant other users a limited right to read and engage with that content within the platform. You retain ownership and can delete your posts at any time.

You are solely responsible for ensuring that Your Content (a) does not infringe any third-party intellectual property rights, (b) is not defamatory, obscene, or otherwise unlawful, and (c) does not violate any applicable law or these Terms.

The Formation Bible Study name, logo, app design, interface, features, source code, study frameworks, reading plans, and all related content (excluding Your Content and Bible text) are the exclusive property of Berean Defense LLC and are protected by copyright, trademark, trade secret, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial Bible study purposes in accordance with these Terms. This license does not include any right to: sublicense the Service, copy or modify the app, create derivative works, or use our branding without permission.

Scripture quotations are from the Berean Standard Bible (BSB), used under its open license. Any other Bible translations displayed in the app are used under their respective licenses. Formation Bible Study does not claim ownership over Bible text. Berean Defense LLC is not affiliated with, sponsored by, or endorsed by the Berean Bible Society. The name "Berean" in our company name is independently chosen and does not imply any relationship with the Berean Bible Society or its publications.

Formation Bible Study uses artificial intelligence to power certain features, including the AI Study Assistant and personalized study recommendations. By using these features, you acknowledge and agree to the following:

Formation Bible Study integrates with third-party services to deliver core functionality. By using Formation Bible Study, you acknowledge that these services operate under their own terms and privacy policies, which are separate from ours.

Formation Bible Study is not responsible for the availability, accuracy, or terms of any third-party service. Links to third-party websites are provided for convenience only — we do not endorse or take responsibility for their content.

Formation Bible Study respects intellectual property rights and expects users to do the same. If you believe that content available within Formation Bible Study infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

DMCA Notice Requirements

Your notice must include all of the following:

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) any errors or defects will be corrected; (c) the Service is free of viruses or harmful components; or (d) results obtained through the Service will be accurate or reliable.

We may update, modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice, and we shall not be liable for any such changes.

Formation Bible Study is a Bible study tool — not a source of theological, pastoral, counseling, legal, financial, or medical advice. Study aids, commentary, and AI responses are for educational purposes only. Consult qualified professionals for decisions in those areas.

In no event shall our aggregate liability to you for all claims arising from your use of Formation Bible Study exceed the greater of: (a) the total amount you paid us in the twelve (12) months immediately preceding the claim giving rise to liability, or (b) fifty U.S. dollars ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Berean Defense LLC and its members, officers, employees, agents, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Formation Bible Study reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense of those claims.

By you: You may close your account at any time through your account settings or by emailing us at [email protected]. Upon account closure, your subscription (if any) will not automatically renew. We will handle your data as described in our Privacy Policy.

By us: We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if we determine that you have: violated these Terms; engaged in fraudulent, abusive, or illegal activity; posed a risk to the safety of other users or the Service; or for any other reason we deem appropriate.

We may also discontinue the Service entirely at any time. If we do, we will provide reasonable advance notice and, where applicable, a prorated refund of any prepaid subscription fees.

Survival: Sections covering intellectual property, your content license grant, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and miscellaneous provisions survive any termination or expiration of these Terms.

Informal Resolution First

Before initiating any formal dispute, you agree to contact us at [email protected] and give us 30 days to resolve the issue informally. We will make a good-faith effort to address your concern.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions about the existence, validity, or termination of these Terms — shall be resolved by final and binding arbitration, rather than in court, except as described below.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Exceptions

Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, without waiving the right to arbitrate. You may also bring small claims court actions in your local jurisdiction if your claim qualifies.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming and applicable federal law of the United States, without regard to its conflict-of-law provisions.

To the extent any dispute is not subject to arbitration under Section 15, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Wyoming for the resolution of such disputes.

We may revise these Terms at any time. When we make material changes, we will notify you by email or through a prominent in-app notice at least 14 days before the changes take effect. For non-material changes (such as clarifications or typographical corrections), we may update these Terms without advance notice.

The "Last updated" date at the top of this page reflects when the Terms were most recently revised. We encourage you to review this page periodically.

Your continued use of Formation Bible Study after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree with updated Terms, you must stop using Formation Bible Study and cancel your subscription before the effective date.
